Legal Sherpa briefing for forward planners

How do you know if it is time to update your will?

It is always a good idea to revisit your Forward Planning documents when life events occur. If any of the following have happened since you signed your will(s) and powers of attorney we invite you to schedule an Equipment Check and Journey Planning Session with a Legal Sherpa lawyer to identify the gaps between what exists and what you wish to happen.

Has your financial situation changed?
Has anyone named in your will(s) died or become disabled?
Has a divorce, marriage, separation or addition of a child occurred?
Are family, community or property laws dealt with in your will(s)?
Have you started a business?
Have you created or developed something?
Have you started a collection?

REMINDER: You cannot alter your will(s) by crossing out or adding something new. Any handwritten change could invalidate your will(s).

Why does your Legal Sherpa team use the language of "Forward Planning" rather than the traditional "Estate Planning"?

It’s because planning for life (including its potential for disabilities and death) is a dynamic on-going process in an ever-changing environment.

We help you clearly identify and then properly address your goals and concerns. We try to help you think holistically and reduce the potential for family discord. We ensure that minor children are entrusted to people who share their parents' values. We forestall the involvement of the offices of the Children’s Lawyer and the Public Trustee. We work to reduce income and estate administration taxes while also looking to protect inheritances from creditors and predators. We help you avoid expensive challenges and disagreements.

At Yeti Law we view a person's financial wealth as representing only a portion of their total wealth. Accordingly we focus on providing Forward Planning Services to our clients rather than just estate planning services.

Our Forward Planning packages address your physical (health) wealth and contingency planning so the people who make decisions about where you live and the care you get (if you can't make those decisions) are the people you choose for you.

Of course, we include Powers of Attorney for the management of your property in our packages.

Another critical piece in our Forward Planning practice is the nomination of a Guardian or Guardians for minor children. We are experienced in helping families far from other relatives in identifying suitable candidates. We also have good experience in helping parents who find themselves unable to concur on a nomination work through a process to help them clarify their wishes and reach agreement.

We also believe that your values and history can be the most valuable part of your legacies for the people who follow you and we have a program to help you capture this part of you wealth so it can be passed on.

As expected, our Forward Planning services include the drafting of wills. But your Legal Sherpa team at Yeti Law won't "take instructions" as we were taught.

First we work with you to identify the people and others you care for, and the people who you would like to act for you and your children if you were unable to take care of matters.

Then we explore your concerns about people (and in many cases the organizations) you want to look after too. Together we devise a plan that will work for you and your beneficiaries - you being the expert on you and we bringing our legal expertise as to what is possible and practical.

Then we follow-up with you to ensure that your plan is still appropriate for your circumstances as Forward Planning is always an ongoing process.
